National Credit Adjusters is a third-party collection agency, headquartered in Hutchinson, KS, and started its business locally in about 2001. National Credit Adjusters is a limited liability company. According to the Better Business Bureau (“BBB”), started its business in 1959. The BBB also lists alternate business names, such as International Homes (affiliated business), NCA, 4 Sum Inc., and . Maybe operated under a different business name when it started in 1959.It appears that collects on debts owed to third parties. If you want to know just how unhappy consumers are with NCA, take a look at the number of lawsuits filed against on the Public Access to Court Electronic Records (“PACER”). PACER is the federal docket throughout the country that lists federal complaints filed against NCA. When you do a search for , there are over 400 lawsuits filed against NCA. Most of these lawsuits involve consumer rights’ violations.
The Fair Debt Collection Practices Act (“FDCPA”) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA. The FDCPA is a laundry list of what can and cannot do while collecting a debt, as well as things debt collectors must do while collecting a debt. If NCA is harassing you over a debt, you have rights under the Fair Debt Collection Practices Act.
The Telephone Consumer Protection Act (“TCPA”) protects you from robocalls. Robocalls are those annoying, automated, recorded calls that a computer makes to you all day long. You can tell it’s a robocall because either no one is on the other end of the line or there’s a delay when you pick up the phone before a live person comes on the line. You can get $500 per call if NCA violates the TCPA. Have you received a message from NCA that sounds pre-recorded? Or, maybe the message you received from NCA is cutoff at the beginning or the end? These are tell-tale signs that the message is pre-recorded. If you have these messages on your cell phone, you may have a TCPA case against National Credit Adjusters.
The Electronic Fund Transfer Act (“EFTA”) protects electronic payments that are deducted from bank accounts. If took unauthorized deductions from your bank account, you may have an EFTA claim. NCA, like most collection agencies, wants to set up reoccurring payments from consumers. Imagine how much money NCA gets if hundreds, if not thousands, of consumers electronically pay them $50-$100, or more, per month. If you agreed to this type of reoccurring payment, NCA must follow certain steps to comply with the EFTA. Did NCA continue to take electronic payments after you said stop? Did NCA take more money from your checking account than you agreed to? If so, let’s talk about your rights under the EFTA.
The Fair Credit Reporting Act (“FCRA”) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We handled a lot of cases recently where reported debt on a consumer’s credit report. NCA likely reports on credit reports to obtain greater leverage over the consumer. If NCA is on your credit report, they may tell you if you pay the debt, they’ll remove it from your credit report. This is commonly known as pay for delete. You pay NCA, and they delete the debt from your credit report. Even if NCA is not on your credit report, maybe the original creditor is. If you pay off the debt to NCA, then the original creditor, and NCA, should accurately report this on your credit report. For example, if is working with, or on behalf of, Summit Receivables, and you pay either party the full amount, or a settlement in full, this payment should be reflected on your credit report.
Several states also have laws that provide its citizens an additional layer of protection. For example, if you live in California, Texas, Florida, North Carolina, Wisconsin, Michigan, Montana, or Pennsylvania you may be able to tack on a state-law claim with your federal law claim above. North Carolina, for example, has one of the most consumer-friendly statutes in the country. If you live in NC, and you’re harassed over a debt, you may get $500.00 - $4,000.00 in damages per violation. We work with a local counsel in NC. Threats and harassment by collection agencies can be pretty intimidating. Well, it turns out we can stop the harassment, attempt to get you money damages under the law, and the collection agency will have to pay us our fees and costs. Here are some of the cases we’ve handled against NCA:
In this case, NCA attempted to collect a RISE personal loan from our client. NCA called our client on his cell phone and on his work phone. NCA called 714-782-0500, which is one of NCA’s phone numbers. Our client told NCA to stop calling, but NCA continued to call. Our client also alleged NCA left him voicemail messages that did not have the proper disclosures. Randall alleged that Summit Receivables violated the Fair Debt Collection Practices Act.
Holly lives in Colorado, and NCA was calling our client on her cell phone. NCA called from 719-281-2699 and 719-281-2681, both of which are numbers belonging to NCA. Our client alleged she told NCA to stop calling. We even sent NCA a cease and desist letter. Despite our client’s efforts, and our cease and desist letter, NCA continued to call Holly in an attempted to collect a debt. We sued NCA in federal court and alleged NCA violated the Fair Debt Collection Practices Act.
Here, NCA was attempting to collect on a debt allegedly owed to Kay Jewelers. NCA called our client from 769-235-2209, and spoke with our client a few times. Each time, our client told NCA the debt had been paid. Our client also told to stop calling. Despite already paying the debt, we alleged NCA continued to call and harass our client. In this case, our client alleged violated the Fair Debt Collection Practices Act.

Although anyone can sue anyone for any reason, we have never seen sue consumers. It’s likely NCA does not sue because they are not a junk-debt buyer. Also, NCA would have to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s likely NCA collects debts through the entire country. Therefore, it would be very difficult to have lawyers, or a law firm, licensed in every state. There are collection agencies that do sue consumers. For example, Portfolio Recovery Associates is one of the largest junk-debt buyers. Portfolio Recovery Associates collects on debt and also sues on debt. So, it would be very unusual if NCA sued you. The original creditor, on the other hand, may hire a collection firm, or lawyer, to sue you. If has threatened to sue you, call us. We can help.
No, not unless they have a judgment. If has not sued you, then NCA cannot get a judgment. If does not have a judgment, then NCA cannot garnish your wages. Minus limited situations (usually dealing with debts owed to the government for student loans, taxes, etc.), in order to garnish someone’s wages, you need a judgment first. In short, we have not seen file a lawsuit against a consumer. So, NCA cannot garnish your wages, minus the exceptions listed above. I received a call today from National Credit Adjusters regarding an account they purchased from Rise credit dating back from Jan 2014. Before she would answer any of my questions about the account sh insisted on having my social security number which I refused to give her. I have never had an account with Rise. Casey could not give me any information on Rise such as their location or phone number so I could contact them directly. She was rude and persistant on me paying this account immediately. I told her it was not mine and I would not be paying it. She said it would continue to ruin my credit.

Do i have to live in IL to retain your services for collections? I have a great deal of medical bills and ambulance rides that have gone to collections. the National Credit Adjuster LLC is trying to collect my tax return they sent a 1099-c form to the Internal Revanue Service to deduct money from my tax return. I JUST RECEIVED A CALL FROM NATIONAL CREDIT ABOUT A PAY DAY LOAN FROM 2012. I HAVE BEEN THROUGH ALL MY LOANS AT THAT TIME AND PAID THEM ALL OFF IN 2013. THIS FIRM WANTED $3100 FOR A $500 LOAN OR $1300 if I could pay $500 today. I feel this is a scam. I received a letter December 22, 2018 about a delinquent account in my name that has been turned over to National Credit Adjusters. I do not owe any money on a delinquent account. This is the first I have heard of this debt. No one else has EVER sent me any bills on this account number. I have never heard of Lion Loan and have NEVER received ANYTHING from them. I was told that an attorney had to be in Ca to fight a case against NCA. Lexington Law advised us to get a police report for identity theft because NCA has been harassing us for 4 years for a debt we do not owe. Yes Lexington Law told us who the original creditor is so I called them and the case was settled but NCA listed it as 4485.00 collection on my husband's credit report. They keep changing the name of the original creditor!
I get calls from The National Credit Adjustors at least 3 times a day everyday. I have blocked probably over 30 different numbers and it is not making a difference. I just had some life events that made it impossible for me to make my payments on things, I am currently at work and cannot talk on the phone at the moment I just wanted to get an idea about what might happen and what it would cost me to get these debt collectors off of my back because I am the only income in my house!

I always advise consumers to get something in writing before making a payment to a third-party debt collector. Without something in writing, how would you know if the company is legitimate or not? Although the Fair Debt Collection Practices Act (FDCPA) does not state what constitutes harassment under the law when it comes to excessive calls, I think 6 calls a day is harassing. National Credit Adjusters call me 6 or more times a day!
Had a payday loan with MobiLoans in which I defaulted and it was transferred to National Credit Adjuster's for collections. Debt was settled, and paid. Now, National Credit Adjuster's is coming after me again to collect on a debt that has been settled. I have both letters attempting to collect at different times and a statement from Debt Consolidation company showing the settlement was paid. The people calling are very rude and even though I've explained this to them, they refuse to do their due diligence on researching on their end to validate my claims!

I was a victim of fraud and every single account that was opened with the exception of this one was removed from my credit report. This one is now with National Credit Adjusters, LLC ... but it was originally with one of those high interest on-line lenders ... They had actually taken money out of my account for monthly payments and that's when I realized that fraud had occurred. They are now reporting this on my credit report and it has just now appeared as of 03.01.18 ... This happened some 3 years ago. I am trying to get a home loan and this is definitely causing me problems as my credit score dropped 100 points effective the date that they reported this erroneous debt. I have a police report and my bank (Arvest) helped me get through all of this and I can't believe that after all this time they are now reporting this!

Hi Susan, I'm sorry to hear you are going through this type of conduct with National Credit Adjusters when you're so sick. I would not worry about the wage garnishment. Before National Credit Adjusters can garnish your wages, they would have to sue you and then get a judgment. I have yet to see National Credit Adjusters sue someone over a debt. hi. im wondering if this immediate credit recovery is a legitimate business? they bought my defaulted loan from dept of education well my original loan amount was only 6,000 dollars over 20 yrs ago. through fault of my own I deferred it and life circumstances prevented me from paying my loan now its at 23,000. and they added a 6000 dollar fee for a total of almost 30,000. I took out an online loan from Rise Credit (I know, I know) for $2,600. I began paying them back at $482.88 a month ($241.44 biweekly), I made a total of 3 payments when I started to question the amount of interest I was being charged. I called Rise Credit to ask about the interest charge stating that in California they can not charge more than 10% of the loan amount and they were charging over 200%. Rise Credit basically told me I didn't know what I was talking about and that I had to pay it all back including the interest charge. I immediately stopped paying on the loan as I felt they were charging predatory interest rates. Rise Credit offered to settle the account for $2400 but would not let me make payments - they wanted the full amount all at once. I told them I did not have enough money to do that so they closed my account and sent it to collections. National Credit Adjusters now has my account from Rise Credit and they are trying to collect $4,475 - I don't even know where this amount came from but it has been reported to all 3 credit bureaus and has dropped my credit score significantly. National Credit Adjusters calls me at work, at home, and at all hours of the day. They use different phone numbers several times a day and when I block the number from calling me they start calling from a different number. I'm not denying that I took out a loan or that I need to pay it back - I just felt that the original loan was illegal and the amount the National Credit Adjusters is trying to collect is illegal as well. I'm not sure if you can help me or not but I came across your site and thought it can't hurt to ask. Thank you for your time and consideration.

I was contacted by a NCA emplyee by using a local phone number, and I want to know if this is a deceptive tactic. Yes, I got behind in paying me account with Cash Net because of medical hardships. I tried to followed the payments agreed upon with this loan company. They never took the money out of my bank account. I called them several times to see if I could do something to speed the payments up on my side. I spoke with several employees of this loan company and still the payments were not withdrawn from my bank. I know this sound weird, but this actually happened. In the meantime, I ended in the hospital. I then I had many medical bills. I am retired and live on a small budget. The NCA employee wanted me to give him my debit card number or my bank account number to set up payments. He wouldn't take anything else and said he needed to get this info. that same day. I told him I would call him in the afternoon that day because I needed to go to the bank to get a prepaid card. He told me that I would probably not call because people tend to do this. My son told me not to call him because he was being rude. I also told him that if for some reason I did not call for him to call me . Then he said that the ball was on my corner and that he would wait for my call. Later that day, he called using their company name and an 800 number. I did not answer because I had time to think that something didn't sound right. It's hard to trust people these days. I am a senior citizen and sick and I don't want to be taken for a fool. I owe Cash Net $339.79. Also after this, I have been getting other 800 no. calls which I had never gotten before. I'm sorry I took too long my RA is pretty bad most days and I has gotten very slow.

I tried to work it out with RISE but I was not moving fast enough so National Credit Adjusters has the account now. NCA call me about 10 times a day non stop. When I try to work out a deal with them it's never good enough or they can't accept certain methods of payment. I'm doing the best I can but, I need some help. Unfortunately I am unable to be reached by phone for most of the day so, would you kindly send me an email. Thank you so much.
Every time I make arrangements to pay them they. Change the method of payment and I can't pay the debt. This increases the debt by interest,etc. Right now trying to pay by mail in order to have return receipt. Mail comes back as not deliverable. Very shady. I am at work and can't take calls or stay on computer
I received a collection letter and I spoke with someone on the phone. They claim I owe someone money, (don't specify amount) and they will have a warrant for my arrest if I do not comply with their offer. I asked them to send me proof of a debt, by regular mail. They say they cannot do that. I said if they cannot sent me proof of a debt, then I will not pay a dime.
National credit adjusters has harassed me for two years over a predatory loan .
These people have been calling for months now and saying I owe a debt but will not give me information as to what it is on and have been rude. They have also called family members and who ever else asking for personal info and giving my personal information out.I also was not given a chance to tell them that I was robbed and a victim of identity theft so there for do not feel comfortable giving them info on something I'm not sure is my doings. This is exhausting to the point I don't want to answer my phone any more due to harassment and I'm missing important calls.
They contacted my Mother and my brother (left a voice mail with him telling him who they were) requesting my whereabouts.
Received call today from National Credit Adjusters 214-414-9750, left message called 1-800-286-5427 x1639 back lady was very very rude..before I could call her back she called a coworker not sure how she got her ph# and when I called back she could not tell me how she got her number either. Demanding that I call today before 6pm or case would sent to my HR and wages will be garnished, I explained that in Texas wages cannot be garnished for this type of debt and she said well its ok for you to borrow and not pay back, I said no that's not what I am saying. I advised repeatedly do not call my employer and she said she would call who she wanted to if this was my employer ph# and she could reach me she would call. Do I call her back, ignore and have the calls continue harassing me and my coworker? Or do I call her back tonight before 6?
Ncredit adjusters has asked me to pay fifty a month towards a 593.00 balance but I know it's not this much as payment s were made how can I get the correct amount owed and do I have to pay them
I had a payday loan for $450 I put a stop payment on my account so they could not take any money out because could not afford to pay it back did not have money like i had for pass loan with company well they told me they will sell account off if I don't make payment arrangement or payoff by May 19,2015 I was not able to do I looked up my account and found out it was sold to National Credit Adjusters and need to deal with them from here on on this debt. I received a call today at 5:27 p.m June 15,2015 from number 901-881-8154 and the guy claims I committed federal crimes with my government ID drivers license and Check Fraud cause of non payment due to the stop payment and he was wanting a disposition to see if it was fraud or not to determine if I go to court . H also mention something about sending papers to the Sheriff Department so I just to him go to court and hung up and i filed complaint on the person but only using the number cause did not know the mans nam e or the who he was working for but filed it the Consumer Financial Protection Bureau. Plus I'm also on social security disability and not receiving much and that's the reason was unable to repay loan.

I went through a company called Payless Financial to mediate a settlement and they took money out of my account for 7 months and it was to go into an escrow account. Needless to say I paid for services I never received and they are no longer in business. Long story short I took out a loan for $3,400.00 on 8/23/13 I mad a total of 12 payments for a total of $3,296.40 and I tried to mediate a settlement through Payless financial. Now I am being bombarded with phone calls from National Credit Adjusters (707) 284-0743. The interest is extremely high and at the end of the day 13 payments later I would have paid $7,142.17 with interest being $3,742.17. Do you represent this type of cases? Do I need an attorney? Is there room for compromise? These people are trying to serve me papers, there is a person that text me and when you call back there is a lot of threats, as well as from the phone calls. They have turned it into collections of which has been recorded on my credit report. It's a night mare. Please advise if you could help me and what fee's will be. I keep getting calls from these people even after I advised them to contact me via USPS only. Representative stated that she would continue to call. I get a call at least 3 times a day.

On 2/16/15, I made payment arrangements with National Credit Adjusters for Payday Loan to settle an amount of $1,500 for $799.00. I agreed to pay $600 up front, and the remainder balance in 30 days. On the 30th day they tried to charge me credit card again for the remaining balance but it was declined. They had called me, and I explained to him nicely I needed 14 more days because I ran into a little snag coming up with the rest on the money. I spoke to a agent by the name of "Kenny", in the Kansas office, and he immediately got so rude and said he was at no liberty to honor the rest of the agreement, then hung up on me. Prior to all of this, he aggressively called my Father cell phone trying to locate me and asked if he can leave him a message. My Father told him he was "not his messenger" and to stop calling him. It's not my Fathers business to know what the call is all about; I am a grown person and not a Minor. Moreover, he continues to call after being so "rude", and hanging up on me.

National credit adjusters just called me this morning and informed me i owe cash net usa 430. I told him i only had 57 cents in my acct. He says that answer is not acceptable. Then he asked if i still worked at one location,i said no then he said oh u work at *name withheld* so u have the money to pay this and this will get paid. I am a single mother working at a call center and i have no extra income for this. This man was extremely rude and demanding
Hi MB, 214-414-9750 is National Credit Adjusters. Once National Credit Adjusters knows they have the wrong number, or the consumer is not located at a specific number, they must stop calling you. So, when you told National Credit Adjusters that your friend cannot be reached at your number, National Credit Adjusters should have stopped calling you. Hi Shannon, I'm sorry to hear National Creditor Adjusters is giving you such a hard time over a debt. However, it does not surprise. Some collection agencies use these tactics to get paid. Regarding the phone conversation being recorded, only in some states does it require the caller to disclose the call is being recorded. So, it depends on where you live. For example, if you live in California, the caller must state the call is being recorded. California is known as a dual-consent state when it comes to call recordings. That is, both parties must be aware the conversation is being recorded. You also have rights under the Fair Debt Collection Practices Act ("FDCPA"). A company called "account Discovery System" has been calling me for 3 months for a collection for National Credit Adjustors. Its for a payday loan in 2011 for 1000.00. Ive paid the payday loan back probably around 800.00. Fell on hard times and counldnt finsih paying it. NOw these pepole say my settlement is $1080.71. and i can make payment agrangements. Then guy tells my i have till the end of the month and thats it. So after the month, calls me again. I know i owe some money, but with all the scams these, i dont know what to do. I talked to him today and he was very nice and we aggreeded i could pay $40 on 17th of April. But when i wouldnt give him my card # to set up payment, he started getting mad. I asked him to Email all the information (he had an old email address). i gave him my correct on. But when i wouldnt give him the card #, he said, hes not wasting his time sending me any more information until i make a payment. And once again, he said, he will not contact me anymore until i call with a payment, but he has said that couple times before and still calls my phone couple times a day until i answer. Its always during my work hours. Also i thought debt collectors had to record the covnersation? Never once was i told the conversation is being recorded. What should i do?

I contacted National Credit Adjusters today and asked to reduce my monthly payment. I am retired and on a limited income and $62.59 is too much for me to pay each month. I offered to pay $25.00 per month and they told me to forget it-was very rude and hung up on me. I would rather not communicate by phone with anyone because I am tired of harassing phone calls.
Hi Christina, Yes, we can certainly help you and your mom. First of all, National Credit Adjusters should not be harassing your mother if she's not the debtor. Once National Credit Adjusters knows that cannot get in touch with you at your mother's house, they must stop calling. Second, if National Credit Adjusters disclosed the debt you alleged owe to your mother, then you have a case against National Credit Adjusters, too. You and your mother are protected under the Fair Debt Collection Practices Act ("FDCPA"). Under the FDCPA, I can get National Credit Adjusters to stop harassing you, get you money damages, and National Credit Adjusters will be responsible for my attorney's fees. National Credit Adjusters has repeatedly call my mother after being given my phone number and asked not to try and contact me through her number. They still call her phone instead of mine to try and get ahold of me. Is there anything that can be done?
Hi Rebecca, You have rights under the Fair Debt Collection Practices Act ("FDCPA"). Once you tell a collection agency, here National Credit Adjusters, that you cannot receive these type of calls at work, the collection agency must stop calling you. If you told National Credit Adjusters to stop calling you at work, and they continue to call you at work, then National Credit Adjusters has violated the FDCPA. Under the FDCPA, I'll get the harassment to stop, you're entitled to money damages of up to $1,000.00, and National Credit Adjusters will be responsible for my fees and costs.
